Mediation is a voluntary and confidential process in which a neutral third party facilitates structured discussion between parties in dispute.
The mediator:
• Acts impartially
• Does not provide legal advice
• Does not make binding decisions
• Does not represent either party
Participation in mediation does not prevent parties from seeking independent legal advice at any time.
2. Voluntary Participation
All mediation services are voluntary. Participation requires the consent of all relevant parties.
Any party may withdraw from the process at any time.
3. Confidentiality
All mediation sessions and related communications are confidential.
Information disclosed during mediation will not be shared outside the process unless:
• All parties agree in writing
• Disclosure is required by law
• There is risk of serious harm
Enquiries submitted through the website are also treated confidentially.
4. No Legal Advice
The mediator does not provide legal, financial, or psychological advice.
Parties are encouraged to seek independent professional advice before entering into any agreement.
5. Settlement Agreements
Any agreement reached during mediation may be documented in writing.
Such agreements may become legally binding once signed by the parties.
It is the responsibility of each party to obtain independent legal advice if required.
6. Fees & Payment
Fees for services are outlined on the Services page or confirmed in writing prior to engagement.
Payment is required prior to the commencement of scheduled sessions unless otherwise agreed.
7. Cancellation & Rescheduling
If a session needs to be cancelled or rescheduled, notice must be provided at least [Insert 24 or 48] hours in advance.
Late cancellations may incur a fee.
8. Limitation of Liability
The mediator acts as a neutral facilitator and does not guarantee specific outcomes.
To the fullest extent permitted by law, Moretti Mediation & Resolution is not liable for:
• Decisions made by parties
• Outcomes of mediation
• Actions taken following mediation
